These Terms of Service ("Terms") govern your access to and use of thersvpplace.com and any associated subdomains (collectively, the "Site"), operated by KANTECH LIMITED (company number 13425835), registered office at Anglo Dal House, 5 Spring Villa Park, Edgware, Middlesex, United Kingdom, HA8 7EB ("we", "us", "our").
By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.
You must be at least 18 years old to register as an Organiser. By creating an account you represent and warrant that you meet this requirement. Guests may be any age; however, if a Guest is under 16, the Organiser is responsible for ensuring they have appropriate parental or guardian consent before providing the Guest's personal data to the Site.
To create an Event you must register for an account. You agree to:
Co-organisers. As an Organiser you may invite other individuals ("Co-organisers") to help manage your Event dashboard. By submitting a co-organiser invitation, you confirm that you have the invitee's consent to share their name and contact details with us for the purpose of sending the invitation. You are responsible for the conduct of any Co-organisers you appoint and for ensuring they comply with these Terms and with applicable data protection law in relation to any guest data they access. You may revoke a Co-organiser's access at any time through the Event dashboard.

We reserve the right to modify, suspend, or discontinue any feature at any time, with reasonable notice where practicable.
Platform administration. Authorised KANTECH staff may access accounts and Event data where necessary to provide technical support, investigate issues, ensure platform security, or maintain the service.
Creating an Event requires a one-time payment of £150.00. This fee is charged at the time of Event creation via our payment processor, Stripe. Payment must be made in full before your Event is activated.

All prices are inclusive of VAT where applicable. We reserve the right to change our pricing at any time; price changes will not affect Events already created.
Statutory cancellation right. Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have a right to cancel a distance contract within 14 days of entering into it without giving a reason (the "Cancellation Period").
Waiver of cancellation right — Event creation. Because the Service commences immediately upon payment (your Event is created and becomes accessible at the point of purchase), we ask you to expressly request that the Service begins immediately and to acknowledge that, once your Event has been created and the Service fully performed, you lose your right to cancel under the Consumer Contracts Regulations 2013. This acknowledgement is collected via an unticked checkbox at the point of checkout. If you do not provide this acknowledgement, we cannot process your payment.
Cancellation before the Service has been performed. If you cancel before your Event has been created (i.e. before payment is confirmed and the Event is live), you are entitled to a refund of the amount received by us. Please note that payment processing fees charged by our payment processor (Stripe) are non-recoverable and will be deducted from any refund issued. Add-ons. WhatsApp credits and additional photo storage are consumed or allocated immediately upon purchase. Because the digital content and services are fully performed at the point of purchase, you expressly waive your right to cancel those purchases (this waiver is also collected at checkout). Once consumed, add-on credits are non-refundable.
Unauthorised chargebacks. If a payment is disputed or charged back without our prior agreement, we reserve the right to immediately suspend or terminate the associated account and Event.
Nothing in this section affects any statutory rights you may have that cannot lawfully be excluded or limited.
Guests access Event pages via a unique invitation link provided to them by the Organiser. No account registration is required of Guests. By accessing an Event page and submitting an RSVP, uploading photos, or leaving a guestbook message, Guests agree to these Terms to the extent applicable to them (in particular, sections 8, 9, and 10).
Ownership. You retain ownership of any Content you submit to the Site. Organisers own Event data and configuration; Guests and photographers retain ownership of photographs they upload.
Licence to us. By submitting Content, you grant KANTECH LIMITED a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, and display that Content solely as necessary to operate and provide the Service. This licence ends when the Content is deleted from our systems.
Our right to remove Content. We may remove or delete any Content at any time, without notice, for any reason, including but not limited to: Content that violates these Terms, Content reported as infringing a third party's rights, technical necessity (e.g. storage limits reached), or following expiry of the storage period. We are not liable for any loss resulting from deletion of Content.
Your responsibility. You are solely responsible for the Content you submit. You warrant that you have all necessary rights to submit the Content and that it does not infringe any third-party rights or applicable laws.

We reserve the right to suspend or terminate your access if we reasonably believe you have violated this section.
When an Organiser uploads guest personal data (names, phone numbers, email addresses, etc.) to the Site, KANTECH LIMITED acts as a data processor on behalf of the Organiser, who is the data controller for that guest data. Organisers are responsible for ensuring they have a lawful basis to provide guest personal data to us, and for informing guests how their data will be used.
We will process guest personal data only as instructed by the Organiser (through use of the Service) and as described in our Privacy Policy. Our processing of Organiser account data is described separately in the Privacy Policy.
Organisers remain responsible for compliance with applicable data protection laws (including UK GDPR) in respect of their guests' personal data.
The Site integrates with third-party services to deliver its functionality. By using the Site you acknowledge that your use is also subject to those third parties' terms and policies:
We are not responsible for the availability, content, or practices of any third-party service.
All rights in the Site, its design, software, trademarks, and original content (excluding User Content) are owned by or licensed to KANTECH LIMITED. You may not reproduce, distribute, or create derivative works from any part of the Site without our prior written consent.
Photo storage associated with an Event will expire 3 months after the Event date. After expiry, uploaded photos may be permanently deleted from our systems. We will endeavour to notify Organisers in advance of deletion.
We may also delete or deactivate an Event and its associated data if: your account is terminated, your Event is found to violate these Terms, or the Event has been inactive for an extended period. Where possible we will notify you before deletion.
You are solely responsible for downloading and retaining any Content you wish to keep before any scheduled deletion.
We aim to maintain a highly available service, but we do not guarantee uninterrupted or error-free access to the Site. We may carry out maintenance or updates that temporarily affect availability, and we will not be liable for any resulting loss.
The Site is provided "as is" and "as available" without any warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Site will be error-free, secure, or continuously available.
To the fullest extent permitted by applicable law, KANTECH LIMITED shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, profits, goodwill, or business opportunity, arising out of or in connection with your use of the Site or these Terms.
Our total aggregate liability to you in connection with the Site, whether in contract, tort (including negligence), or otherwise, shall not exceed the total amount paid by you to us in the 12 months preceding the event giving rise to the claim.
Nothing in these Terms limits or excludes our liability for: death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded.
You agree to indemnify and hold harmless KANTECH LIMITED, its officers, directors, employees, and agents from and against any claims, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to: your use of the Site, your Content, your violation of these Terms, or your violation of any third-party rights.
We may suspend or terminate your account and access to the Site at any time, with or without notice, if we reasonably believe you have violated these Terms or for any other legitimate reason. You may close your account at any time by contacting us.
Upon termination, your right to access the Site ceases immediately. We may retain your data as required by law or for legitimate business purposes; otherwise we will delete it in accordance with our Privacy Policy.
We may update these Terms from time to time. We will notify registered Organisers of material changes by email. The "Effective date" at the top reflects the latest revision. Continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.
These Terms are governed by and construed in accordance with the laws of England and Wales. You agree to submit to the exclusive jurisdiction of the courts of England and Wales to resolve any dispute arising out of or in connection with these Terms or your use of the Site.
